Judge denies city's Beachwood motions

The city of Half Moon Bay has lost again in the courtroom of U.S. District Judge Vaughn Walker. Tuesday the judge denied a motion seeking new findings of fact in the Beachwood land-use case or an amended judgment that currently stands at more than $41 million for an aggrieved developer.

The 13-page document dismisses a range of arguments, including the notion that plaintiff's waited to long to file their federal suit, that the judge lacked jurisdiction in the case and that the judge made "clear errors" in handing down his decision.

"Many of these arguments are simply repetitions of arguments already presented to and discussed and rejected by the court," Walker wrote in part.

Now that Walker has ruled on the post-trial motions, the city has 30 days to file an appeal. In a statement just last week, Mayor Bonnie McClung reiterated the city's intention to do so.
