Mayor discusses Beachwood developments

In a press release issued late Friday, Half Moon Bay Mayor Bonnie McClung reiterated in no uncertain terms the city's plan to appeal the Beachwood land-use decision unless a federal judge accepts the city's motion challenging findings of fact in the case.

Attorneys for both the city and developer Charles Keenan appeared before U.S. District Judge Vaughn Walker on Thursday. They delivered motions that have already been filed with the court. The city challenges some of Walker's assumptions in his December judgment, which ruled the city owes Keenan in excess of $36 million for unlawfully taking his property along Highway 1.

Walker heard arguments but issued no ruling Thursday.

In addition, McClung noted that Assemblyman Gene Mullin has introduced legislation that can be amended to allow for some future settlement with the developer. Closed-door settlement talks between the parties have been ongoing.

But McClung again made no bones about the city's course of action, should the motion be denied. "If the motion is denied, Judge Walker's decision becomes final and the city will appeal the decision," the release states.
