Attorneys for both the city and developer Charles Keenan appeared before U.S. District Judge Vaughn Walker on Thursday. They delivered motions that have already been filed with the court. The city challenges some of Walker's assumptions in his December judgment, which ruled the city owes Keenan in excess of $36 million for unlawfully taking his property along Highway 1.
Walker heard arguments but issued no ruling Thursday.

But McClung again made no bones about the city's course of action, should the motion be denied. "If the motion is denied, Judge Walker's decision becomes final and the city will appeal the decision," the release states.
